C-42) and international copyright laws, including the Berne Convention. This includes all economic rights (such as reproduction, distribution, public display, and adaptation) and moral rights (such as attribution and integrity of the work).

  • 1. Ownership and Licensing: Warren Sharpe Photography retains full ownership and copyright in all Content. No transfer of ownership occurs through viewing or accessing this website. Any use of the Content requires a prior written licensing agreement from Warren Sharpe Photography. AI and Machine Learning Restrictions: In light of emerging technologies, the Content may not be used for training, fine-tuning, or input into artificial intelligence (AI) systems, machine learning models, generative tools, or any automated processes that create synthetic images, deepfakes, or derivatives. This includes, but is not limited to, scraping, data mining, or feeding Content into AI platforms for any purpose. Such uses infringe on copyright and may violate additional laws related to data protection and intellectual property.

  • 4. Digital Rights Management: Metadata embedded in images (e.g., EXIF data) must not be removed or altered. Watermarks, if present, are integral to the work and their removal constitutes infringement.

  • 5. Fair Dealing Exceptions: Limited fair dealing under Canadian law (e.g., for research, private study, education, parody, satire, criticism, review, or news reporting) may apply, but only if it does not harm the market for the original work or infringe moral rights. Any such use must properly attribute the source as "© Warren Sharpe Photography – www.sharpephoto.ca".

  • 6. Enforcement and Remedies: Warren Sharpe Photography actively monitors for unauthorized use and reserves the right to pursue all available remedies, including injunctions, damages (statutory or actual), accounting of profits, and legal fees. Infringements may be reported to platforms, search engines, or authorities for takedown under the Notice and Notice regime or similar mechanisms.
